V. Environmental Acceptability of the Bio Green System Technology Process
The Bio Green System Technology Process has passed and exceeds all European and US atmospheric emissions standards. It has passed the latest US EPA (Environmental Protection Agency) regulations including the Batneec Guidance Note for the Waste Sector (Revision 1-May 1996), the Council Directive on June 8 1989 (89/369/EEC) and the Common position (EC) No. 7/2000 adopted by the Council directive on November 1999 (2000/C 25/02).
The process is also allowed under the Clean Air Act (RA 8747) since it is done usings a gasification process. Only incinerations which emit fumes that are not in conformity with internationally accepted standards are prohibited. The provision in Section 20 of R. A. 8747 prohibits or bans incinerations or open burning of wastes (MMDA vs JANCOM, G.R. 147465, January 30, 2002).
The Supreme Court states, to wit;
"Section 20 does not absolutely prohibit incineration as a mode of waste disposal. Rather, only those burning processes which emit poisonous and toxic fumes are banned."
